AB-Inbev attacks Dutch brewer Bavaria Bier in CUBA

The world’s largest beer producer is claiming damages and interests to the Dutch for participating in the construction of a brewery

Brewing giant AB InBev has taken legal action in the Netherlands against Swinkels Family Brewers, the Dutch brewer of Bavaria beer. AB InBev is claiming damages from the Dutch because they are participating in the construction of a brewery in Cuba, reports the Dutch channel RTL Nieuws. In 2002, AB InBev received from the Cuban authorities the exclusive right, for 30 years, to brew and market beer on the Caribbean island. But in 2019, this exclusivity was withdrawn. In the process, AB InBev initiated arbitration proceedings.

At the same time, it therefore seems that the Belgian-Brazilian group has also taken legal action against Swinkels Family Brewers. AB InBev accuses the Dutch family business of having acted improperly by taking advantage of the violation of its exclusive right.

The beer giant demands that Swinkels cease its activities in Cuba and claims in court if necessary a penalty of 25,000 euros per day, as well as damages of an unspecified amount.

The court of the Oost-Brabant region nevertheless considered that it was not competent, the case concerning a decision taken by the Cuban State.
